The petitioner is apprehending his arrest in connection with Lalmatia P.S. Case No.9/2026, registered for the offence under Section 303(2) of the BNS, Section 30(ii) of Coal Mines Act and Sections 4, 21 of JMMRD Act, pending in the Court of the learned Judicial Magistrate, Godda. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be owner of tractor and the allegations are made of loading 3 tons of coal on the said vehicle. She further submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 9 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of illegally loading 3 tons of coal on the said vehicle. 5. Considering that the petitioner is the owner of the vehicle in question and he has got no criminal antecedent, as disclosed in paragraph 9 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Godda in connection with Lalmatia P.S.
