The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 249/2025, registered at Police Station Surajpur, District – Surajpur (C.G.) for the offence punishable under Sections 317(4), 318(2), 61(2) (A) of BNS and Section 66(d) of IT Act. 2. The case of the prosecution, is that on the basis of complaints of online cyber fraud received through the Indian Crime Coordination Centre Co-ordination portal at 60509060759 Police Headquarters, VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.22 11:11:47 +0530 2 Nava Raipur (C.G.), information and bank statements were obtained from Bank of Maharashtra and Axis Bank regarding certain accounts in the name of Anand Kumar Kurre and Narender Kurre, which revealed transactions relating to several acknowledgments of cyber fraud complaints. It is alleged that the applicant Anand Kumar Kurre gave his Bank of Maharashtra Account No. and Axis Bank Account No. 924010050838208, and along with co-accused Narender Kurre and others, made available multiple bank accounts and associated ATM cards and SIMs to cyber fraudsters in different States for illegal financial gain, for which they received amounts per account and about 3,99,800/- rupees were transacted in 18 complaints through about 10 bank accounts. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the charge-sheet has been filed in this case. It is further submitted that during the investigation, it was found that there is transactions of amount of only Rs.48,000/- in the bank account of applicant. He also submits that there are total 16 prosecution witnesses, out of which only 7 witnesses have been examined. The applicant is in jail since 03.07.2025 and trial is likely to take some time for its conclusion and main accused has already been granted bail by this Court in MCRC No.9117 of 2025 vide order dated 07.01.2026, therefore, he prays for grant of bail on the ground of parity. 4. On the other hand, the learned State counsel opposes the bail application and submits that applicant has no criminal antecedents. He could not disputed the fact that main accused has already been granted bail by this Court in MCRC No.9117 of 2025 vide order dated 3 07.01.2026. He also submits that as per this Court’s order dated 03.03.2026, concerned Investigating Officer has filed his personal affidavit in the present case, in which he stated that there are four complaints belongs to the present applicant which received the acknowledgment that the applicant is having two bank accounts in which the bank account No. 60509060759 the amount of Rs.38,000/- and 10,000/- was transacted from this account to another account, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. In compliance of the Court’s order dated 03.03.2026, the Investigating Officer of the subject crime number, Police Station – Surajpur, District – Surajpur (C.G.), has filed his affidavit showing the incriminating evidence collected against the applicant during the course of investigation, and relevant paragraph of the affidavit is quoted here as under: “3. That, the matter was heard by this Hon'ble Court on 03.03.2026 and the Hon'ble Court directed to file the affidavit of the investigation officer in relation to the evidence collected against the present applicant, the applicant Anand Kurre has been arrested by the Police of Police Station Surajpur, District- Surajpur (CG) on 03.07.2025 and he is in jail in connection with Crime No. 249/2025. 4.That, several complaints has been received at the Indian Cyber Crime Coordination Portal from the different banks and thereafter the complaints have been forwarded to the concerned Police Station from the office of Inspector General, SIB/ CCTNS/Cyber Police, Chhattisgarh Headquater- Nawa Raipur, Chhattisgarh. During the investigation it was found that the present applicant Anand Kurre, S/o Raju Kurre, resident of Kesgao, P.S. and Tehsil- Sonhat, District- Koriya (CG) if having bank account No. 4 60509060759 belongs to bank of Maharastra Brach- Surajpur and another Bank Account bearing No. 924010050838208 belongs to another bank, branch of Surajpur and the transaction details of the aforesaid bank accounts has been collected by the investigation officer, it was found that there are four complaints belongs to the present applicant which received the acknowledgment, that the petitioner is having two bank accounts in which the bank account no. 60509060759 the amount of Rs. 38, 000/- and 10,000/- was transacted from this account and from another account No. 92401005083820 which is another bank account of the accused, an amount of Rs. 5,000/- and total 10,000/- has been transacted. The copy of the transaction details is annexed herewith as case diary.” 7. Taking into consideration the facts and circumstances of the case, and from the perusal of the case diary and applicant has no criminal antecedent. Further considering the fact that the investigation reveals that only amount of Rs.48,000/- has been transacted through his bank accounts and there are total 16 prosecution witnesses, out of which only 7 witnesses have been examined, further main accused has already been granted bail by this Court in MCRC No.9117 of 2025 vide order dated 07.01.2026 and applicant is is jail since 03.07.2025 and conclusion of the trial is likely to take some time, I am inclined to allow this application. 8. 8. Accordingly, this bail application of applicant – Anand Kurre, involved in Crime No.249/2025, registered at Police Station Surajpur, District – Surajpur (C.G.) for the offence punishable under Sections 317(4), 318(2), 61(2)(A) of BNS and Section 66(d) of IT Act, be released on bail on his furnishing a personal bond with two sureties in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the 5 dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicant shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 9.
