By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the petitioner seeks quashing of FIR No. 609/2016, registered at Police Station K.N. Katju Marg (Outer), Delhi, for the offences punishable under Sections 354, 451, 427, 506, 509 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. 4. Brief facts of the case are that the present FIR came to be registered on 17.08.2016, at the instance of Respondent No. 2, in respect of an incident dated 16.08.2016, against the petitioner and four other persons, namely Anand Saxena, Geeta Saxena, Sumit Saxena and Pankaj Pal, who have since expired and against whom the proceedings stand abated. The present FIR is the subject matter of a cross-case between the parties, a cross-FIR bearing No. 608/2016 having been registered on the same day, in respect of the same incident, at the same Police Station, at the instance of the petitioner’s sister. Learned counsel for the Petitioner submits that the parties are neighbours, and that, with the intervention of common friends and relatives, they have amicably resolved all their disputes and misunderstandings vide Settlement/Compromise Deed dated 27.03.2026, agreeing to cooperate in the quashing of their respective cross-FIRs to restore harmony between them. 6. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, has categorically stated that she has entered into the settlement vide Settlement/Compromise Deed dated 27.03.2026 out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. 7. In view of the above, and given that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose would be served by continuing the proceedings, rather the same would only create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
