1. Petitioner has filed this writ petition seeking following reliefs:

When the case was listed for the first time on 02.04.2026, submission was made by learned counsel for the petitioner that Enquiry Officers earlier appointed by respondent department have shown their inability to conduct enquiry for reason mentioned by them before the department and thereafter the enquiry initiated against the petitioner could not be proceeded for long time. Petitioner, apprehending that again he will not be able to get promotion on the higher post because of pendency of enquiry, has filed this writ petition with prayer that in such circumstances according to provision of law, Enquiry Commissioner is to be appointed with intervention of General Administration Department (GAD). 3. Considering the submission of learned counsel for petitioner this Court has passed following order:
“In the facts of the case and the submission made by learned counsel for the respective parties, learned counsel for the respondent- State is directed to seek instruction in this regard on appointment of Enquiry Commissioner in accordance with the rules, and make submission on the next date of hearing.”
4. When the case is taken up for hearing, Mr.
Y.S. Thakur, learned Additional Advocate General submitted that by order dated 16.04.2026 one C.B. Londekar, Additional Director, Agriculture has been appointed as Enquiry Officer and now enquiry proceeding initiated against petitioner will be concluded
-3- expeditiously in accordance with law. He also submits that in the aforementioned facts of case, as the enquiry is still to be concluded, relief as prayed for by petitioner in para-10 of writ petition cannot be granted. 5. Learned counsel for the petitioner at this stage submits that petitioner is suffering since last seven years. He is apprehending that within a short period of time respondent -Department may initiate proceeding of promotion from the post of Joint Director to the post of Additional Director and if enquiry is not completed at the earliest, petitioner will made to suffer. 6. Considering the facts and circumstances of the case and also considering submission of learned counsel for respondent -State based on order dated 16.04.2026 that Enquiry Officer has now been deputed and enquiry will be started and concluded expeditiously, I find it appropriate to dispose of this writ petition at this stage directing the Enquiry Officer and respondents to take all necessary steps to conclude enquiry initiated against the petitioner and pending since last about seven years, in accordance with law, expeditiously, preferably within a period of six months from the date of receipt of copy of this order, subject to cooperation of the petitioner. 7.
