This writ petition has been filed seeking following reliefs: “ I) Issue a writ order or direction in the nature of mandamus directing to the respondent no. 1 and 2 to remove the road constructed over the abadi land of the petitioner of Gata No. 388 c [388 Ga] situated in Village Bhojapur, Mauja Ranwa, Pargana Taalgram, Tahsil Chibaramau, District Kannauj. II) Issue a writ order or direction in the nature of mandamus directing to the respondent no.2 to take the action against the respondent no. 4/5 under Section- 95 of the U.P. Panchayat Raj Act, 1947. III) Issue a writ order or direction in the nature of mandamus directing to the respondent no. 2 to provide the possession to the petitioner over the abadi land of the petitioner over which the road has been constructed.“ 3. After hearing learned counsel for the petitioner, Court finds that it is a highly disputed fact, therefore, cannot be decided by this Court. However, this writ petition is disposed of with an observation that in case an application is filed before the appropriate authority which has jurisdiction to consider such nature of dispute, said authority will consider it in accordance with law.
