The present MCC has been filed for modification of the order dated 23- 8-2024 passed by this Court in MAC No. 145 of 2017. This Court while admitting the appeal on 6-2-2017 has directed that the amount to be deposited in the State Bank of India, High Court Branch in a form of FDR and that amount will not be released to any of the claimants till disposal of the appeal. The said amount is still lying with the State Bank of India, High Court Branch and that amount after getting annual increment as per rate of interest payable in FDR has not come upto Rs.16,80,897/- and the claimants after dismissal of the appeal and also vacating the interim order passed by this Court on 6-2-2017, since the amount has not been deposited with the learned Motor Accident Claims Tribunal, Kondagaon, District Kondagaon, the said amount could not be released to them as per the award dated 8-11-2016 passed by the said Tribunal. Therefore, the present MCC has been filed for modification of the order dated 23-9- 2024 passed in MAC No. 145 of 2017. 2. Accordingly, the order dated 23-8-2024 passed by this Court in MAC No. 145 of 2017 is modified to the extent that the interim order passed by this Court on 6-2-2017 is vacated and the amount so deposited in the State Bank of India, High Court Branch, in pursuance of the order passed by this Court on 6-2-2017 shall be transferred immediately to the learned Motor Accident Claims Tribunal, Kondagaon, District Kondagaon, which will disburse the amount as per the terms of the award passed by it. It is also directed that the entire amount deposited- along with accrued interest till the date of transferring the 3 amount will be transferred by the State Bank of India, High Court Branch and the compliance report shall also be sent to the learned Motor Accident Claims Tribunal, Kondagaon for further compliance of the order. 3. A copy of this order be forwarded to the Branch Manager State Bank of India, High Court Branch for immediate compliance. 4. The remaining part of the order dated 23-8-2024 passed by this Court in MAC No. 145 of 2017 shall remain in tact. 5. With the aforesaid modification, this MCC No. 442 of 2026 is disposed of.
