The petitioner is apprehending his arrest in connection with Bariyatu P.S. Case No. 01 of 2026, registered for the offence under Sections 17(b), 22(b) and 29 of the NDPS Act, pending in the court of learned Special Judge (NDPS), Latehar.

Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the basis of confessional statement and the opium has been recovered from the possession of other co-accused and the quantity of recovered opium i.e. 0.514 kg (514 gms.) is intermediary in quantity. He next submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-13 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement.

Considering that the name of the petitioner has come on the basis of confessional statement and even the quantity of recovered

opium is intermediary in nature and in the attending facts and circumstances of the case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS), Latehar, in connection with Bariyatu P.S. Case No. 01 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
