1. With the consent of the parties, matter is heard finally.
2. Applicant has filed this petition seeking seeking following prayer:
“1. The Hon'ble Court may kindly be pleased to allow the present Review Petition and review/recall the order dated 28.08.2025 (Annexure P/1) passed in W.P.C No. 4516/2025; and/or
2. Direct that the Petitioner be impleaded as a necessary party and thereafter pass appropriate orders after granting opportunity of hearing; and/or
3. Pass any other order(s) as this Hon'ble Court may deem fit and proper in the interest of justice.”
3. Relevant portion of order dated 28.08.2025 passed in W.P.(C) No.4516/2025 (Shivdayal Pathak versus State Of Chhattisgarh & Ors), reads as under:
“5. Considering the facts of the case and submission made by counsel for the respective parties, this writ petition is disposed of directing to respondent No.3– Tahsildar, Berla, District Bemetara (C.G.) to consider and decide the Annexure P-2 & Annexure P-5 expeditiously preferably within a period of ‘03 months’ from the date of receipt of copy of this order, in accordance with rules, regulations and law.”
4. At the outset, learned counsel for the respective parties contended that this petition may be disposed with a direction to the concerned respondent-authority to consider and decide the ‘Annexure P-2 & Annexure P-5 of W.P.C No.4516/2025’ on its own merits, after considering the objection of the petitioner herein, expeditiously,
3 preferably within a period of ‘45 days’ from the date of receipt of copy of this order, in accordance with rules, regulations and law.
5. In view of above submission, it is ordered that Para-5 of the order dated 28.08.2025 passed in WPC No.4516/2025 shall stand replaced/substituted as follows:-
“5. Considering the facts of the case and submission made by counsel for the respective parties, this writ petition is disposed of directing respondent No.3/Tahsildar, Berla, District Bemetara (C.G.) to consider and decide the Annexure P-2 & Annexure P-5 on its own merits, after considering the objection of the petitioner herein, expeditiously, preferably within a period of ‘45 days’ from the date of receipt of copy of this
order, in accordance with rules, regulations and law.”
6. Copy of this order be placed in WPC No.4516/2025 and also supplied alongwith copy of order dated 28.08.2025.
7. With the aforesaid modification, instant review petition stands
disposed of. Certified copy as per rules.
