INDIRESH ORAL ORDER In this writ petition, the petitioner is challenging the order dated 26th February, 2026 (Annexure-D) passed by the respondent No.5, wherein, the petitioner herein was suspended from the post of Chief Executive Officer of the respondent No.4- Society. - 3 - HC-KAR NC: 2026:KHC:16515 WP NO.8198 OF 2026 2. Heard Sri. Jayakumar S. Patil, learned Senior Counsel on behalf of Sri. Sandesh T.B., appearing for the petitioner; Sri. Yogesh D. Naik, learned Additional Government Advocate appearing for respondents 1 to 3; and Sri. M.S. Rudraiah, learned counsel appearing for the respondent No.5. 3. Sri. Jayakumar S. Patil, learned Senior Counsel appearing for the petitioner invited the attention of the Court to the order dated 13th June, 2025 (Annexure-C) passed by the respondent No.3 and submitted that the tenure of Administrator was extended from 12th March, 2025 to 11th August, 2025 and thereafter, the tenure of the Administrator was not continued. Accordingly, learned Senior Counsel submits that the impugned order dated 26th February, 2026 (Annexure-D) passed by the respondent No.5 suffers from jurisdiction as the respondent No.5 has no jurisdiction to pass an order after completion of tenure of the Administrator. 4. Per contra, Sri. M.S. Rudraiah, learned counsel appearing for the respondent No.5 submits that the tenure of the Administrator from 11th August, 2025 was not continued, - 4 - HC-KAR NC: 2026:KHC:16515 WP NO.8198 OF 2026 however, recommendation has been made for continuation of the Administrator in the respondent No.4-Society. 5. Having heard the learned counsel appearing for the parties and taking into consideration the fact that the order dated 13th June, 2025 (Annexure-C) passed by the respondent No.3, extending the tenure of the Administrator for looking after the affairs of the respondent No.4-Society till 11th August, 2025 and thereafter, the same has not been continued, I am of the view that the respondent No.5 has no jurisdiction to issue the impugned order. Therefore, impugned order dated 26th February, 2026 (Annexure-D) passed by the respondent No.5 is hereby quashed. In the result, writ petition is allowed.
