JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioners seek the following reliefs: "a) Allow the Petition. b) Issue a Writ of Certiorari quashing the order dt:- 05.01.2026 at Annexure-G, passed by the III Addl. Sr. Civil Judge & JMFC, Devenahalli, on IA 4 filed Under Sec. 151 CPC for disbursement of amounts, At Annexure G in MISc.No.55/2017. c) Cost of the Petition, d) And pass such other order/s as this Hon'ble Court be pleased to grant to the Petitioner in the circumstances of the cases, in the interest of justice and equity." 2. On 27.01.2026, this Court passed the following interim order: "Heard. Sri. Prakash Angadi, learned counsel is directed to accept notice for respondent No.1. Copies to be served. Re-list on 03.02.2026. In the meanwhile, all further proceedings in Misc.No.55/2017 on the file of the III Addl. Senior Civil Judge & JMFC, Devanahalli, are hereby stayed, till the next date of hearing. Learned counsel for the petitioners submits that the present petition may be disposed of reserving liberty in favour of the petitioners to take recourse to such remedies as available in law including seeking appropriate reliefs in RSA No.1241/2021 and the interim protection granted by this Court may be continued for a limited period. 4. Submission is placed on record. 5. A perusal of the material on record will indicate that the petitioners, who are not parties to the impugned proceedings, have no locus standi to file the present writ petition and as such present writ petition is not maintainable. 6. However in order to enable the petitioners to take recourse to such remedies as available in law and to seek appropriate reliefs in the pending RSA No.1241/2021, in the peculiar/unique/special facts and circumstances of the instant case, without expressing any opinion on the merits/demerits of the rival contentions, I deemed it as inappropriate to continue the interim order passed by this Court for a period of three weeks from today. - 6 - HC-KAR NC: 2026:KHC:9084 WP No. 2284 of 2026 7.
