1. In the instant application under Section 12 and 13 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India and the Contempt of Courts (Gauhati High Court) Rules, 1977, the Petitioner has prayed for initiating contempt proceedings against the Respondents for wilful and deliberate violation of the order of this Court passed in WP(C)/92/2023.
2. Learned counsel for the Petitioner, Ms. Kainyü K. is present. Mr. N. Angami, learned Senior Government Advocate is present for Respondent No. 1 and Ms. Marylena for Respondent Nos. 2, 3 and 4 representing Mr. S. Temjen.

A perusal of the order dated 31.05.2024 passed in WP(C)/92/2023 shows that the Petitioner was directed to submit a fresh application for compassionate appointment before the respondent authorities and on such application being made by the Petitioner, the respondent authorities were directed to examine and take decision for appointment of the Petitioner to any suitable post on compassionate ground in terms of the Office Memorandum dated 17.09.2015 within a period of 4 (four) months
Page No.# 3/3 from the date of receipt of a certified copy of the order dated 31.05.2024. Thereafter, the Petitioner submitted a fresh application to the Director, Rural Development Department, Nagaland, Kohima and upon
consideration of the same, the respondent authorities intimated the Petitioner regarding consideration of her case vide letter dated
07.08.2024. In the letter dated 07.08.2024, the respondents have intimated to the Petitioner that her application for compassionate appointment under the scheme has been considered and her name has been placed at Serial No. 18 in the list maintained for compassionate appointment in the Department and further stated that her appointment shall be considered as and when her turn comes as per the serial number.
4. At page 22 of the amended contempt petition, the Waiting List for Compassionate Appointment w.e.f. 21.10.2019 has been annexed wherein the name of the Petitioner appears at Serial No. 19.
5. The Compassionate Appointment Scheme of the Government of Nagaland dated 17.09.2015 clearly envisages a maintenance of a waiting list of the compassionate appointment applications and, therefore, this Court is of the view that the order of this Court dated 31.05.2024 in WP(C)/92/2023 has been substantially complied with by the Respondents and accordingly, the matter is closed and disposed of.
