Petitioner Mr. Mrityunjoy Chatterjee …for the petitioner Ms. Amita Gaur Mr. Mujibar Ali Naskar …for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner is named as an accused in a double murder case. However, he is one of about 40 accused in this case. He has been falsely implicated in this case. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the post-mortem reports of the two victims and the injury reports of other injured witnesses. He also refers to the statements of witnesses, including those recorded before the learned Magistrate. He has been specifically named as an assailant by one such eye-witness, as would be evident from page 179 of the case diary. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.
