Janardhana Reddy, Advocate for R2; Notice to R1 is dispensed with V/o dated 17.07.2025 ) This Writ Petition is filed under Article 227 of The Constitution Of India, praying to quash the impugned order dated 29.03.2025 passed by the Court of VI Addl., District and Sessions Judge and MACT, at Tumakuru, in MVC No.1060/2023 produced at Annexure-D and pleased to allow the application filed by the petitioners in I.A.No.1/2025 under Section 152 of CPC vide Annexure-C. This petition coming on for Conciliation before Lok Adalat, the following Conciliation Order is passed: 3 CONCILIATION ORDER 1. Learned counsel appearing for the parties have filed a Joint Memo dated 21.02.2026. It is averred in the Joint Memo that the respondent No.2 - Insurance Company has agreed to pay a lumpsum of Rs.17,65,000/- towards full and final settlement of the dispute. 2. The Memo reads as under: "The WP filed against the Judgment and Award in M.V.C.1060/2023 on the File of the MACT, TUMKUR, has been referred to this Lok Adalat by the Hon'ble High Court U/S.20 of the Legal Services Authorities Act.1987. The parties to the appeal have settled their claim before the Lok Adalat on the following terms: The Petitioner/s-Claimant/s has/have agreed to receive and Respondent No.2 ORIENTAL INS. CO. LTD., has agreed to pay a lump-sum of Rs.17,65,000/-(Rupees Seventeen Lakh Sixty Five Thousand Only), in addition to what has been awarded by the Tribunal, in full and final settlement of the claim. 4 The Respondent No.2 ORIENTAL INS. CO. LTD., has agreed to deposit the said amount, before the Tribunal, within six weeks from the date of preparation of award failing which the said amount shall carry interest at 9% p.a. from the date of default, till the date of deposit. The parties are not entitled for any cost. The parties to this WP have set their hands to this settlement before the Lok Adalat in the presence of Conciliators on this 21/02/2026 Bengaluru Bench." 3. As per the aforesaid Memo, the respondent - Insurance Company has agreed to pay a lumpsum of Rs.17,65,000/- in addition to what has been already awarded by the Tribunal. The said amount is directed to be apportioned at the ratio of 50% each, in favour of claimant Nos.1 and 2 respectively. 4. The additional amount shall be deposited and released as per the order of the Tribunal in MVC No.1060/2023, dated 20.12.2024. In all other respects, the order of the Tribunal remains unaltered. 5 5. Accordingly, the Order dated 20.12.2024 passed by the Court of VI Addl. District and Sessions Judge and MACT, at Tumakuru, in MVC No.1060/2023, shall stand modified. 6. With the above observation, the Writ Petition stands disposed of.
