Kausik (Allowed) CRM (NDPS) 1102 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1447 of 2024 dated 13.09.2024 under sections 21(c)/27A/29 of the NDPS Act and under Section 61(2) of BNS, 2023. And In the matter of : Saddam Sk. @ Saddam Hossain ……Petitioner. Mr. Sourav Chatterjee, Sr. Adv. Mr. Aditya Tiwari ……for the Petitioner. Mr. Bibaswan Bhattacharya Mr. Mainak Gupta ……for the State. Learned Senior Advocate for the petitioner submits that the petitioner is in custody for 201 days and is similarly situated as the other accused person who has been granted bail in CRM (NDPS) 1426 of 2025. Having considered the observation made therein as follows :- “Be that as it may, prima facie, it reflects from the charge-sheet that CDRs have not been relied upon. Having regard to the period of custody undergone and there was no recovery from the present petitioner and petitioner has been implicated on the basis of statement of co-accused, I am of the view that further detention of the present petitioner in 2 connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed.” - I am of the view that in spite of objection raised by the State, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Saddam Sk. @ Saddam Hossain shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court (under NDPS Act) cum Learned Additional Sessions Judge, 4th Court, Malda. If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1102 of 2025 is allowed. The Investigating Officer of the case is present in Court pursuant to the directions passed. His further appearance before the Court is dispensed with. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
