And In the matter of : Akash Mondal. ……Petitioner. Mr. Jisan Iqbal Hossain ……for the Petitioner. Mr. Joydeep Roy, Ld. Jr. Govt. Adv. Ms. Debolina Das ……for the State. Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 30 bottles of phensedyl but petitioner has been implicated on the basis of the statement of co-accused and is in custody for 100 days. Learned advocate for the State submits that the petitioner has a chequered career with 27 antecedents including NDPS Act cases. Having considered that charge-sheet has been submitted and there has been no recovery at the instance of the present petitioner, I am of the view that further detention is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, petitioner namely, Akash Mondal shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction 2 of the learned Judge, Special Court under NDPS Act, cum learned Additional District Judge, 3rd Court, Malda.. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court in seisin of the case and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Accordingly, the prayer for bail in CRM (NDPS) 229 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
