Neutral Citation No. ( 2026:JHHC:14551-DB ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Criminal Appeal (D.B.) No. 589 of 2026 Raju Ram @ Dhruv Jee @ Gurdian @ Guardian, S/o Dukhan Ram, R/o Village- Hotari, P.O.- Asehar, P.S.- Panki, District- Palamau ... … Appellant Versus The State of Jharkhand ... … Respondent --------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY HON'BLE MR. JUSTICE PRADEEP KUMAR SRIVASTAVA --------- For the Appellant : Mr. Rajesh Kumar, Advocate For the Respondent : Mr. Shiv Shankar Kumar, A.P.P. --------- 02/13.05.2026 Heard Mr. Rajesh Kumar, learned counsel for the appellant and learned A.P.P. for the State. This appeal is directed against the order dated 07.04.2026 passed by the learned Additional Sessions Judge- I, Latehar in B.P. No. 120/2026, arising out of Herhanj P.S. Case No. 41/2024, corresponding to G.R. Case No. 63/2026, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been submitted by the learned counsel for the appellant that the appellant has been implicated on the confession of co-accused persons. Learned counsel submits that in similar circumstances some of the co-accused have been granted bail in Criminal Appeal (D.B.) No. 175 of 2025 and Criminal Appeal (D.B.) No. 334 of 2025. Learned counsel adds that the appellant is in custody since 17.10.2025 Learned A.P.P. has opposed the prayer for bail of the appellant. It appears that there was an exchange of firing between the extremists and the Police personnel and after the extremists had fled away on a search conducted at the place of occurrence several incriminating articles were recovered. However, since it appears that the appellant has been implicated primarily on account of the confession of co- accused persons and some of the co-accused persons having already been granted bail as noted above, we while setting aside the order dated 07.04.2026 passed by the learned Additional Sessions Judge-I, Latehar in B.P. No. 120/2026, arising out of Herhanj P.S. Case No. 41/2024, corresponding to G.R. Case No. 63/2026, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Latehar in connection with Herhanj P.S. Case No. 41/2024, corresponding to G.R. Case No. 63/2026. This appeal stands allowed. (Rongon Mukhopadhyay, J.) (Pradeep Kumar Srivastava, J.) Dated, the 13th May, 2026 A.
