HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 21703 of 2026 Court No. - 49 HON'BLE AJAY BHANOT, J. HON'BLE DIVESH CHANDRA SAMANT, J. The only prayer pressed by the learned counsel for the petitioner is for a direction upon the respondents to conduct fair investigations. Learned AGA on the basis of instructions submits that pursuant to fair and impartial investigation, charge-sheet has been filed. Faced with this, Shri Suraj Upadhyay, learned counsel holding brief of Shri Vivek Singh, learned counsel for the petitioner submits that the petitioner does not wish to press the writ petition and seeks leave to assail the charge-sheet under Section 528 BNSS. The writ petition is accordingly dismissed. It is always open to the petitioner to avail other legal remedies under the BNSS against the charge-sheet as may be advised.
