Petitioner is before this Court seeking for the following relief:- (a) Issue a writ in the nature of certiorari or order of similar nature, quashing the order dated 06.09.2019 in No.Sam:Joint Commissioner/MDV/A- 09/2016-17 passed by the Second Respondent, at Vide Annexure - H and order dated 24.01.2020 in SKOA/MSD/P.R/97/19-20 passed by the 3rd respondent at Vide Annexure - J and direct the respondent No.3 to register the katha to the name of the petitioner in the BBMP records. - 3 - HC-KAR NC: 2026:KHC:9477 WP No. 13723 of 2023 2. One Smt. Perumamma i.e. respondent No.4 had executed General Power of Attorney in favour of One Sri. K. Venkateshwara Rao, who had formed sites in property in Sy.No.19 and sold one of the sites to one Sri. G. Satish, who in turn sold the said site to Sri. Tarun Verma, which was in turn purchased by the petitioner. 3. Subsequent thereto, the said property coming within the BBMP limits, it was found that the entries made in the name of Tarun Verma were not transferred in the BBMP records. But the property continued in the name of respondent No.4 and respondent No.4 sold the said property in favour of respondent No.5. An application has been made by the petitioner for transfer of khata in his name. The said application came to be rejected vide impugned order at Annexure - H passed by respondent No.2, which was confirmed by respondent No.3 vide order dated 24.01.2020. Challenging both these orders, the petitioner is before this Court seeking for the aforesaid relief. - 4 - HC-KAR NC: 2026:KHC:9477 WP No. 13723 of 2023 4. The factual matrix indicates that there is a sale deed in favour of the petitioner. There is also a sale deed in favour of respondent No.5. Such being the case, the respondent Nos.2 and 3 acting in their quasi-judicial authority in revenue jurisdiction cannot transfer a khata in the name of the petitioner as sought for by the petitioner. Though the sale deed in favour of the petitioner is prior in point of time, it is but required for the petitioner to seek for appropriate reliefs before the appropriate forums and then approach the respondent Nos.2 and 3 for transfer of khata in his name. Reserving such liberty, the petition stands disposed. 5. Liberty is reserved to the petitioner to file appropriate proceedings and seek for necessary interim orders in those proceedings.
