Learned counsel for the Respondents submits that there are some other Appeals between other parties are pending and he has no objection if present Appeal is allowed and the matter is remanded back to learned ASCJ- cum-JSCC to be heard on merits, who had dismissed the First Appeal bearing RCA No.4/2022 on the ground of delay of 1143 days on the ground that all Defendants were being represented by one SPA Holder and Suit was decided vide common Judgment dated 26.12.2016, while SPA Holder had filed Appeals in respect of other Defendants. Appeal pertaining to the Appellant herein could not be filed, which resulted in delay of 1143 days. 3. Considering the submissions made, delay of 1143 days in filing the Appeal is condoned and impugned Judgment dated 20.12.2025 is set aside This is a digitally signed order.
