IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No.3248 of 2026
----- Shambhu Paswan @ Sambhu Paswan, son of Kapil Paswan, resident of Onda, PO Onda, PS Asthawan, District Nalanda, Bihar
… Petitioner(s). Versus The State of Jharkhand
… Opposite Party(s). CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Md. Zaid Ahmed, Advocate For the State
: Mr. Bhola Nath Ojha, Spl.PP
…...... 03 /08.05.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 20(b)(ii)(c) and 22(c) of the NDPS Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned Spl.PP opposes the prayer for bail. 4. Admittedly 15 kg of ganja was recovered from the possession of this petitioner. His bail application was earlier withdrawn by the petitioner from this Court on 18.02.2026 in BA No. 11129 of 2025, which suggests that since the bail was probably not being granted, he withdrew the same. 5. The petitioner refers to the order dated 18.03.2026 passed in BA No. 2140 of 2026 whereby the coordinate Bench of this Court has granted bail to the co-accused. This order of the coordinate Bench is after the bail of the petitioner was withdrawn from this Court. There is nothing on record that the aforesaid order of withdrawal was placed before the coordinate Bench or not. 2026:JHHC:13801

6. The facts remains that admittedly from the physical possession of this petitioner 15 kg of ganja was recovered and he was caught red handed, thus, I am not inclined to grant privilege of bail to the petitioner. The petitioner is in custody since 21.06.2025, which cannot be said to be for a very long period. 7. Accordingly, the prayer for bail of the petitioner in connection with Dhanbad P.S. Case No. 220 of 2025 arising out of NDPS Case No. 16 of 2025 pending in the Court of learned Principal District and Sessions Judge, Dhanbad stands rejected. 8. Accordingly, this bail application is dismissed. 9. The Trial Court should expedite the trial and try to conclude the same preferably within seven (7) months from the date of production of this order before the Trial Court. 10.
Let a copy of this order be transmitted to the concerned Trial Court. (ANANDA SEN, J.) 08.05.2026 Tanuj/CP-3
