Sinha, Advocate ---- 02/07.05.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Koderma P.S. Case No.10 of 2026, for the alleged offences registered under Sections 303(2), 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 26(1)(g), 33, 41 and 42 of Indian Forest Act and Sections 27 and 29 of Wild Life Protection Act, 1972 pending in the Court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioners submits that allegations are made of doing illegal mining and it has been alleged that two JCB machines along with dumper were found in the forest area. He 2026:JHHC:13729 --2-- A.B.A. No. 2182 of 2026 further submits that so far these petitioners are concerned only on suspicion their name have come. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.10 of the petition. He next submits that petitioners have nothing to do with dumper or JCB machines. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of doing excavation in the forest area. 5. Considering that the name of the petitioners has come only on suspicion and it has been pointed out that the said JCB machines and dumper are not related to the petitioners and further the petitioners have got no criminal antecedent as disclosed in paragraph No.10 of the petition, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Koderma P.S.
