Petitioner has filed this petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the records of the case of the state for kind perusal of this Hon'ble Court. 10.2 That, this Hon'ble Court may kindly be pleased to issue appropriate writ or direction, directing the respondents to extend the benefit of Time Scale Pay with all consequential benefits after completing 10 years service as Lecturer, to the petitioner in light of Circulars dated 28.04.2008,04.08.2010 and 11.01.2010 to the petitioner from 19.06.2022 along with arrears & interest at the rate of 12% per annum in favour of the petitioner within stipulated time as this Hon'ble Court deems fit looking to the fact that the petitioner is retired employee. 10.3. Cost of the petition may also be granted to the petitioner. 10.4 Any other relief deemed fit in the facts and circumstances of the case may also be granted..” 2. Learned counsel for the petitioner submits that the petitioner was initially appointed on the post of Assistant Teacher. He was promoted to the post of Lecturer on 19.06.2012. After completion of 10 years of service on the post of Lecturer on 19.06.2022 he became entitled for grant of first time scale pay, but he was not granted benefit of first time scale pay as per the circular of the State Govt. Petitioner has submitted -3- representation before respondent authority ventilating his grievance, however till date no decision has been taken on it. He submits that as the representation is pending consideration since 02.06.2023, a direction be issued to respondents No.2 to 5 to take decision on the claim of petitioner within specified time. 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for the petitioner, she is having no objection and if the representation is still pending consideration, decision will be taken in accordance with law subject to verification of the facts. 4. Taking into consideration the prayer made by learned counsel for the petitioner, of a direction to take decision on the pending representation, instead of keeping this writ petition pending seeking reply from respondents this writ petition at this stage is disposed of permitting the petitioner to submit fresh comprehensive representation before respondents No. 2 to 5 and if such representation is submitted, the concerned respondents shall consider and decide the same in accordance with law, after verifying the facts, expeditiously, preferably within a period of 3 months from the date of receipt of copy of this order.
