The present application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking grant of anticipatory bail in connection with FIR No. 0269/2026 registered at Police Station Bharat Nagar, under Sections 118(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’). 4. Learned counsel for the Applicant submits that initially Sections 118(1) and 3(5) of the BNS were invoked against the present Applicant and, since the offences were bailable, the Applicant was served with a notice under This is a digitally signed order. Learned APP for the State, who appears on advance notice, opposes the present application and submits that the Applicant is specifically named in the FIR and that it was the Applicant who stabbed the injured. He further submits that the injured has already been discharged from the hospital. 6. In the facts and circumstances of the case, the present application is allowed. In the event of arrest, the Applicant shall be released on bail on furnishing a personal bond in the sum of Rs. 25,000/- with two sureties of the like amount, to the satisfaction of the Arresting Officer/Investigating Officer concerned, subject to the following conditions: i) The Applicant shall join the investigation as and when directed by the Investigating Officer and shall cooperate with the investigation. (ii) The Applicant shall provide his mobile number to the Investigating Officer and shall keep the same operational at all times. In the event of any change in the mobile number or residential address, the Applicant shall intimate the same to the Investigating Officer. iii) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Investigating Officer. iv) The Applicant shall not leave India without the prior permission of this Court.
