In sequel to order, dated 21.04.2026, respondents No. 1 and 2 stand served, however none has put in appearance on their behalf. Therefore, they are proceeded against ex-parte.
Heard. The present application have been filed for condonation of delay in filing the main appeal. It has been averred in the application that though the certified copy of the impugned judgment, dated 27.08.2025 was applied on 20.11.2025 and delivered to the applicant on 12.12.2025, however due to inadvertence and oversight, the same was misplaced and could not be traced despite best efforts. Upon retrieval of the aforesaid certified copy, after due diligence, prompt action was taken for preparation of the appeal. Thus, it has been averred that the aforesaid delay is neither intentional nor deliberate, but has occurred due to unavoidable circumstances, which were beyond the control of the applicant.
Learned Deputy Advocate General has no objection in case the application is allowed.
Consequently, in view of the reasons stated in the application, which is duly supported by an affidavit, coupled with submissions made by the learned counsel for the applicants, delay in filing the main appeal is condoned. Appeal be registered. Application stands disposed of.
