Page No.# 2/3 This is an application filed under Section 483 of the BNSS, 2023 in connection with Golaghat P.S. Case No. 24/2026, under Section 61(2)/318(4)/316(4)/303(2) of the BNS, 2023 read with Section 23(1) of the Petroleum Act, 1934. The learned Addl. Public Prosecutor submits that the Case Diary has been received. The Addl. Public Prosecutor submitted that the oil tanker had been recovered without the oil. The learned counsel for the petitioner has submitted that the petitioner has spent 53 days in custody and it is a matter of the fact that he had handed over the truck to the other co-accused since he was ill. Having gone through the contents of the Case Diary and the length of the detention, this Court is of the opinion that the petitioner can be granted the privilege of bail at this stage. Accordingly, the petitioner shall be released on bail on furnishing a bond of Rs. 20,000/- with 2(two) sureties of the like amount subject to the satisfaction of CJM, Golaghat. The Ld.
