JUSTICE PARTHA SARTHY ORAL ORDER 4 07-05-2026 1. Heard learned counsel for the parties. 2. The petitioners have preferred this application for grant of regular bail in connection with Purnea Sadar P.S. Case no.551 of 2025 registered under sections 331(4) and 305 of the Bhartiya Nyay Sanhita, 2023. 3. As per the prosecution case, the informant states Patna High Court CR. MISC. No.17374 of 2026(4) dt.07-05-2026 2/3 that unknown accused persons broke open the lock of his house and committed a theft of Rs. 2.5 lakhs in cash besides gold and silver ornaments as mentioned in the FIR. 4. Learned counsel appearing for the petitioner Akash Uraon submit that the FIR was registered against unknown. The petitioner was falsely implicated in the case in course of investigation. No incriminating article has been recovered from the petitioner's possession nor any TI parade has been conducted. The petitioner is in custody since 6.11.2025. 5. Learned counsel appearing for the petitioner Vikram Kumar Rishi submits that the FIR was registered against unknown. The petitioner was falsely implicated in the case when on the alleged confessional statement of this petitioner, some stolen articles are said to have been recovered. Neither any recovery took place nor any confession was given by this petitioner. It is further submitted that though the petitioner was arrested on 31.10.2025 he was remanded on 6.11.2025. 6. Learned APP appearing for the State submits that as a result of the confession of both these petitioners, stolen articles were recovered from their respective houses and further the articles recovered were identified by the informant in the TI parade. Further the petitioner Vikram Kumar Rishi has an Patna High Court CR. MISC. No.17374 of 2026(4) dt.07-05-2026 3/3 antecedent . 7. Having heard learned counsels for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation, the stolen articles having been recovered on the confession of these petitioners and the informant having identified the stolen articles in the TI parade conducted, the Court is not inclined to enlarge petitioners on bail and the application of both the petitioners are rejected. 8.Liberty is granted to the petitioners to renew their payer for bail after six months or after framing of charge, whichever is later.
