According to the petitioner, his property was damaged at the time of road cutting for construction of Sahiya- Kwanu Motor Marg, however, no compensation for said damage has been paid to him. By means of this writ petition, petitioner has sought the following relief:- “(a) Issue a Writ, Order or direction in the nature of mandamus commanding the respondents to consider the case of the petitioner and pay the compensation according to the condition and norms settle by the respondents according to the actual damage of the courtyard, cowshed, fruit trees and harvest etc. of the petitioner.” 5. Mr. Shailendra Singh Chauhan, learned counsel appearing for respondent nos. 3 to 7 submits that the road was constructed in 2008-09 and the road has now been handed over to Public Works Department. He submits that petitioner has approached this Court after much delay. 6. Learned counsel for the petitioner has drawn attention of this Court to a letter dated 19.7.2022, issued by 2026:UHC:283 Superintending Engineer, PMGSY, Mussoorie, which is addressed to Executive Engineer. By this letter, according to learned counsel, claim of the petitioner was referred to the Executive Engineer for decision. Learned counsel for the petitioner further submits that Annexure-8 to the writ petition is the representation made by the petitioner, which is pending consideration before the Executive Engineer. He submits that the Executive Engineer be directed to take decision in the matter. 7. Having regard to the facts of the case, the writ petition is disposed of with a direction to the Executive Engineer, PMGSY, Kalsi, District Dehradun to take decision on the representation made by the petitioner (Annexure-8 to the writ petition), as per law, within four months from the date of presentation of certified copy of this order. All stakeholders shall also be heard while taking decision.
