ORAL ORDER
This petition is filed under Section 439(1)(b) of Cr.P.C. praying to modify the order dated 24.01.2026 passed in Crl.Misc.No.294/2026 by XLV Additional Civil and Sessions Judge (CCH-46), Bengaluru City and permit the petitioner to deposit nominal cash surety instead of Rs.50,000/- as ordered by the Sessions Judge.
2. Heard the learned counsel for petitioner and learned Additional SPP for respondent/State.
3. Petitioner had sought anticipatory bail in Crime No.76/2023 of Bharati Nagar Police Station in Crl.Misc.No.6920/2023 and the same came to be allowed

by order dated 08.08.2023. In the order, the Sessions Court has imposed a condition to furnish one solvent surety for Rs.1,00,000/-. The petitioner has sought modification of the said condition in Crl.Misc.No.294/2026. The said petition came to be allowed and condition has been modified. The petitioner has been directed to furnish cash surety of Rs.50,000/- instead of a solvent surety. The petitioner is now before this Court seeking modification of the said condition of furnishing cash surety to a nominal amount.
4. It is submitted by learned counsel for the petitioner that the petitioner is a poor woman and she is not able to deposit Rs.50,000/- and prays to impose nominal cash security. Considering the fact that the petitioner is a lady aged about 60 years, she has made out a case for modification of the condition. In the result, the following:

ORDER
The petition is allowed. The condition imposed in the
order dated 24.01.2026 in Crl.Misc.No.294/2026 directing to furnish cash security of Rs.50,000/- is modified and the petitioner is
directed to furnish cash security of Rs.20,000/-.
