JUSTICE DEEPAK ROSHAN For the Petitioner(s) : Mr. Saurabh Shekhar, Advocate For the Respondent(s) : Mr. Suresh Kumar, SC (L&C)-II -------- Order No. 2 /Dated: 5th May 2026 The instant writ application has been filed by the petitioner for the following reliefs: “1.(i) For the issuance of appropriate writ(s)/ order(s)/ direction(s), commanding upon the Respondents to consider the case of the petitioner, for grant of promotion from the post of Junior Engineer to the post of Assistant Engineer, in the AMIE degree quota, as he has completed requisite Kalawadhi for consideration of promotion in the AMIE 10% decree quota; ii. For the issuance of appropriate writ(s)/ order(s)/ direction(s), commanding upon the Respondents to grant promotion to the petitioner, alongwith all consequential benefits, w.e.f the due date, that is the date from when he is entitled to be promoted, alongwith all consequential benefits; 2026:JHHC:13382 2 And/Or iii. For the issuance of any other appropriate writ(s)/ order(s)/direction(s) for doing conscionable justice to the petitioner.” 2. The grievance of the petitioner is that since he is fully entitled to be considered for grant of promotion from the post of Junior Engineer to the post of Assistant Engineer in AMIE degree quota as he has completed requisite Kalawadhi for consideration of promotion in the AMIE 10% degree quota as such, the concerned respondent may be directed to take a decision in the matter and pass a favourable order in view of their own circular. 3. Learned counsel for the respondents submits that since no counter affidavit has been filed as such the petitioner may be relegated to the concerned respondent so that his grievance can be addressed. 4. Having regard to the submission and looking to the prayer made in this writ application, the instant writ application stands disposed of by directing the respondent no.1-Additional Chief Secretary, Department of Energy, Government of Jharkhand to consider this writ application as a representation of the petitioner and take a decision in the matter strictly in accordance with the applicable rules and regulations of the Department as well as the settled proposition of law by passing a reasoned and speaking order within a period of 12 weeks from the date of receipt of this order and the petitioner is directed to serve a copy of entire memo of this writ application so that his grievance can be redressed as early as possible. 5. It goes without saying that if the petitioner is found fit as per the circular of the respondents, then necessary consequential order shall also be passed within a further period of four weeks. 6.
