JUSTICE B M SHYAM PRASAD - 6 - HC-KAR NC: 2026:KHC:7462 WP No. 4082 of 2026 ORAL ORDER The petitioners are the Members of an Association [the fifth respondent] which is registered under the Karnataka Societies Registration Act, 1960 [for short, 'the Act']. The petitioners assert that the fifth respondent is incorporated for the purposes of running recreational and indoor sports activities. Smt. Sarala V M, the learned counsel for the petitioners, submits that though the term of the Managing Committee has expired in the month of August 2025, the elections have not been held and therefore appropriate directions must be issued. Sri B N Suresh Babu, the learned counsel who is permitted to accept notice for the fifth respondent, when queried, submits that with some of the members of the Association filing objections, the fifth respondent has filed a representation with the Government for appointment of Returning Officer for due conduct of the elections and that the fifth - 7 - HC-KAR NC: 2026:KHC:7462 WP No. 4082 of 2026 respondent would not oppose a direction to the second respondent to appoint a Returning Officer who could oversee the elections. Smt Saritha Kulkarni, a learned Additional Government Advocate who accepts notice for the first to fourth respondents, is heard in the light of these circumstances. The Government's intervention in the affairs of the Society must be in the circumstances provided for under the Act and this Court must opine that at this stage nothing is brought to this Court's notice to issue directions to the authorities to appoint a Returning Officer to conduct and oversee the elections. It should be the responsibility of the fifth respondent's Managing Committee to notify the elections. When queried in this regard, Sri B N Suresh Babu submits that after appropriate resolution, the elections would be notified within a month. - 8 - HC-KAR NC: 2026:KHC:7462 WP No. 4082 of 2026 This submission is taken on record, and the petition stands disposed of reserving liberty to the petitioners to avail remedy with this Court if the fifth respondent's Managing Committee reneges on the statement as aforementioned.
