The petitioner is apprehending his arrest in connection with Excise Complaint Case No.3326 of 2024, for offence registered under section 47(a) of Excise Act, pending in court of learned SDJM at Daltonganj, Palamu.

Learned counsel for petitioner submits that the name of the petitioner has come only on suspicion and the allegations are made of recovery of 30 litres of liquor and 1400 kg of jawa mahua was made from the bank of the Khajurba River and the petitioner has got no criminal antecedent as disclosed in paragraph 13 of the petition.
4. Learned State counsel opposes prayer and submits that the name of the petitioner has come on suspicion.

Considering that the name of the petitioner has come on suspicion and the recovery of the said liquor and jawa mahua

was found from the bank of the Khajurba river and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned SDJM at Daltonganj, Palamu, in connection with Excise Complaint Case No.3326 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
