1. The present civil transfer application filed under Section 24 of the Code of Civil Procedure, 1908 (CPC) seeks the transfer of Civil Suit No. 94/2019, titled 'M/s Brown & Black Bio Pvt. Ltd. v. Bullford World Ltd. & Ors.', pending before the Court of the learned District and Sessions Judge, Jaipur, to any other competent Court of jurisdiction.

Learned counsel for the applicant/defendant submits that the applicant has a reasonable and bona fide apprehension that it will not get justice before the said Court. He contends that the a bare perusal of the various order-sheets as well as rejection of the applicant's application with costs of Rs. 5,000/-, vide order dated 11.05.2026, reflects a biased approach, thereby necessitating the transfer of the present suit.
3. Heard learned counsel for the applicant and carefully perused the material available on record.
4. From a bare perusal of the record, it is revealed that the apprehension of the applicant is wholly misplaced. The order- sheets of the learned Court below (Annexure-2) speak to the contrary. It is evident that the civil suit was filed on 15.07.2017, wherein the applicant (defendant therein) was granted numerous opportunities to lead its evidence on 17.05.2025, 30.08.2025, 06.10.2025, 17.11.2025, 20.12.2025, 20.01.2026, and 13.03.2026; however, having failed to do so, its right to lead evidence was consequently closed by the Court on 23.04.2026.
5. Furthermore, having perused the orders dated 04.07.2026 and 13.07.2026 (Annexure-6), this Court is of the considered opinion that merely rejecting a subsequent application filed under
Order 8 Rule 1-A(3) of the CPC, after considering the delay and imposing costs, cannot ipso facto be termed as a valid ground to apprehend that the applicant will not get justice. In the absence of any substantiated proof, such judicial orders do not reflect any personal bias on the part of the Presiding Officer.
6. On examination of the record, this Court is of the considered opinion that there is no valid or proper ground for transferring a
[2026:RJ-JP:31790] (3 of 3) [CTA-290/2026] case from one Court to another merely upon the unfounded apprehension or wish of a litigant. If such baseless transfer applications are entertained on the mere asking of a party, without any substantiating evidence of bias, it would open a Pandora's box, thereby creating unnecessary delays in the adjudicatory process and undermining judicial discipline.
7. Consequently, the arguments raised by the learned counsel for the applicant lack merit. The present civil transfer application, being devoid of merit, is hereby dismissed.
8. All pending applications, if any, shall stand disposed of.
9. The Registrar (Judicial) is directed to forward a copy of this
order to the applicant, for necessary compliance.
