HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 30082 of 2026 Court No. - 21 HON'BLE ARINDAM SINHA, J. HON'BLE SATYA VEER SINGH, J. 1. Today is returnable date for hearing and disposal of the writ petition. Petitioner's case will appear from paragraph 1 of order dated 11th September, 2026, reproduced below. "1. Mr. Awadhesh Kumar, learned advocate appears on behalf of petitioner and submits, under challenge is, inter alia, letter dated 25th June, 2026, whereby the oil company cancelled his client's candidature for obtaining dealership of the retail outlet (RO). He hands up the brochure to rely on clause 4(vi). Relied upon provision in the sub-clause is reproduced below. "4(vi) ............. In case land offered by all the applicants under Group 1 & Group - 2 is found not suitable/not meeting requirements, then these applicant/s under Group - 1 & Group-2 along with applicants under Group - 3 (who did not offer land along with application) would be advised by the OMCs to provide suitable land in the advertised location /stretch, within a period of 90 days from the date of issuance of intimation letter to them through SMS/e-mail. In case the applicant fails to provide suitable land within the prescribed period, or the land provided is found not meeting the laid down criteria, the application would be rejected. ..................." He submits, his client belongs to the category entitled to opportunity of offering alternate land within 90 days. The cancellation without giving such opportunity is bad." Mr. Devi Shanker Shukla, learned advocate appears on behalf of respondents Versus Counsel for Petitioner(s) : Awadhesh Kumar, Vinay Singh Rajput Counsel for Respondent(s) : Devi Shanker Shukla Krishna Kumar Chauhan .....Petitioner(s) Indian Oil Corporation Limited And 2 Others .....Respondent(s) (the oil company) and relies on view taken by co-ordinate Bench on order dated 6th March, 2024 disposing of Writ-C no.7354 of 2024 (Rahul Singh Vs. Indian Oil Corporation Ltd and 3 others). We interrupt Mr. Shukla to point out from relied upon order dated 6th March, 2024, in paragraph 7, clause 4 of the brochure stands reproduced. The passage preceding other conditions given by clauses a onwards and passage reproduced in our earlier order dated 11th September, 2026 are the same. Mr. Shukla submits, petitioner's application was duly considered and rejected. However, the passage is applicable to the facts and circumstances, wherein no plot offered has met with approval. In such a situation, we see that order dated 6th March, 2024 (supra) does not stand in the way for petitioner to have relief of offering alternative land within 90 days from date. 2. Petitioner will communicate certified copy of this order to respondent no.2, the proper authority according to Mr. Shukla. Petitioner has till 5th January, 2027 to offer alternative plot. 3. The writ petition is disposed of. October 5, 2026 Kpy WRIC No. 30082 of 2026 2 (Arindam Sinha,J.) (Satya Veer Singh,J.)
