ORAL ORDER The petitioners – accused Nos.1 to 3 are before this Court calling in question proceedings in C.C.No.4722/2022, pending before the II Additional Senior Civil Judge and JMFC, Tumakuru, for the offences punishable under Sections 498A, 323, 504 and 506 r/w. 34 of the IPC.

Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before this Court in R.P.F.C.Nos.193/2025 and 115/2024 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the Karnataka Mediation Center. Therefore, they are before this Court seeking permission to compound the offences. They have filed an application – I.A.No.1/2026 under Section 482 of the Cr.P.C., supporting affidavit and also a joint memo before this Court to that effect.
3. The joint memo reads as follows:
“Petitioner No.1 and Respondent No.2 jointly submits as follows:

1. Petitioner No.1 and Respondent No.2 had filed RPFC NO. 193/2025 and RPFC No. 115/2024 challenging the maintenance ordered. The said revision petitions were referred to mediation and in mediation both petitioner No.1 and Respondent No.2 have resolved the said petitions and also all connected cases on agreed terms and conditions. As per one of the condition in the agreement, 2nd respondent has agreed to co-operative to close/ quash C.C.No.4722/2022 arising out of crime No.79/2022 registered by the respondent No 1 on a complaint filed by the respondent No.2 against petitioners for the offences punishable under section 498A, 323, 504 R/W 34 of IPC. Accordingly, both petitioner No.1 and 2nd respondent are filing this joint memo and requesting to quash C.C. No.4722/2022 which is pending before the II Additional Senior Civil Judge and JMFC, Tumakur insofar as petitioners are concerned in the interest of justice and equity.”
In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the joint memo and terminate the proceedings against the petitioners, as the allegations are not against the State.
4. For the aforesaid reasons, I pass the following:
ORDER (i) The criminal petition and I.A.No.1/2026 are
disposed.

(ii) The proceedings in C.C.No.4722/2022, pending before the II Additional Senior Civil Judge and JMFC, Tumakuru, stand quashed.
