2. The allegations against the petitioner are under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), and Sections 25 and 27 of the Arms Act, 1959.

Learned counsel for the petitioner submits that the charge sheet has already been filed. The material witnesses have been examined, and none of them has supported the case of the prosecution. It is further submitted that no useful purpose would be served by keeping the petitioner behind bars.
4. Per contra, learned APP for the State submits that there is CCTV footage and the statement of the daughter of the deceased, who is an eye- witness to the incident. He submits that although these witnesses have not supported the case of the prosecution during trial, the Court cannot ignore their statements recorded under Section 161 of the Code of Criminal This is a digitally signed order. Procedure, 1973 (hereinafter referred to as the ‘CrPC’). He further submits that the other material witnesses regarding the recovery of the weapon of offence, i.e., the pistol, are yet to be examined.
5. The allegations are under Section 103 of the ‘BNS and from the incident as reported in the FIR, it is very clear that petitioner has shot dead the deceased with a clear intention and motive to kill him. No ground for bail is made out.
6. Accordingly, the application is dismissed. Pending application(s), if any, are also disposed of.
7. The next date of hearing i.e., 17.07.2026 stands cancelled.
