Learned advocate appearing for the petitioner submits that the petitioner is a conductor of a bus and from the roof of the bus 99.78 kgs. of ganja were recovered. Petitioner is in custody for 10 months 7 days and till date only charges have been framed and the prosecution intends to examine 20 witnesses to prove its case. Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been seized. Having considered the same, I am of the opinion that rigors of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner is rejected. 2 State is directed to expedite the process of trial and at least give priority to the vital witnesses be examined. Accordingly, CRM (NDPS) 528 of 2026 is dismissed at this stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
