The petitioners are apprehending their arrest in connection with Rehla PS Case No.99 of 2024, for offence registered under section 191(2), 191(3), 190, 126(2), 115(2), 117(2), 103(1), 352, 351(2) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Palamau at Daltonganj. 3. Learned counsel for petitioners submits that there are case and counter case between the parties and there is land dispute. He next submits that there is no doubt that the injury has been received upon the son of the informant, who has subsequently died. He next submits that, however, there are general and omnibus allegations against all the accused persons and in view of that, anticipatory bail may kindly be granted. 4. Learned State counsel opposes prayer and submits that allegations are there of assault and pursuant to that, son of the informant has died. 5. Looking to the contents of the FIR, it transpires that 2026:JHHC:14727 2 there are general and omnibus allegations of assault against all the accused persons, except, Radhe Shyam Paswan @ Radheyshyam Ram who is petitioner no.1 and there is direct allegation against Radhe Shyam Paswan @ Radheyshyam Ram/petitioner no.1 to assault the son of the informant and pursuant to that, he has received the injury, and died, and in that view of the matter, I am not inclined to grant anticipatory bail to the petitioner no.1, namely, Radhe Shyam Paswan @ Radheyshyam Ram, and as such, prayer for anticipatory bail on behalf of the petitioner no.1, namely, Radhe Shyam Paswan @ Radheyshyam Ram is, hereby, rejected and this anticipatory bail application is, hereby, dismissed, with respect to petitioner no.1. 6. So far as the petitioner nos.2 to 4 are concerned, there are general and omnibus allegations against them, and there are case and counter case and the injury is said to be received by both the sides, and in that view of the matter, I am inclined to grant anticipatory bail to petitioner nos.2 to 4. 7. Accordingly, the petitioner nos.2 to 4, namely, Mukesh Paswan, Soni Devi and Raju Paswan @ Raju Kumar, are, hereby, directed to surrender before learned court within two weeks from today, and in event of their surrender/arrest, the petitioner nos.2 to 4, namely, Mukesh Paswan, Soni Devi and Raju Paswan @ Raju Kumar, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to the satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj, in connection with Rehla PS Case No.99 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
