ORDER Date : 28.08.2026 Heard Mr. M. Islam, learned counsel for the petitioners and Mr. M.P. Goswami, learned Addl. Public Prosecutor, Assam, appearing for the State respondent No. 1.
2. Mr. M. Islam, learned counsel for the petitioners who submits that the petitioners are the mother and the co-villagers of the accused No. 1, who has established physical relationship with the minor daughter of the informant. The
learned counsel for the petitioners has submitted that the petitioners being the ladies may be granted to the privilege of pre-arrest bail.
3. The learned APP has submitted that the investigation has culminated in a charge sheet being CS No. 82/2026, dated 31.07.2026 in connection with Sapatgram PS Case No. 73/2026 (corresponding to GR Case No. 380/2026) registered under Sections 64(1)/ 88/ 89 of the BNS, 2023, read with Sections 6/17 of the POCSO Act.
4. The learned counsel for the petitioners has submitted that the petitioners would be appeared before the learned Trial Court and in the event summons is received by them.
5. Observing that after submission of charge sheet, there is no apprehension of arrest by the investigating authority, this anticipatory bail application is closed, by allowing the petitioners to appear before the learned Trial Court as and when summons are received and pray for appropriate relief.
