GP FOR REVENUE The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ Order, or direction more particularly one in the nature of Writ of Mandamus, declaring the illegal action of the respondents 2 to 6 in not taking action on the Complaints made petitioners brother on his behalf dated.31-03-2026, 06-04-2026 13-04-2026 against the persons who trespassed into petitioners house Plot No.140, Sy.Nos.229, 298 296/3 an extent of 40x33 square feet i.e., Ac.0.03 cents situated at Panchalingala Village Fields, Panchalingala Gram Panchayat, Kurnool Rural Mandal, Kurnool District, due to influence of local MP they trespassed and erected the stone during mid night on 31-03-2026 on the same day the petitioner submitted a report to the respondent and further report dated.06-04-2026 to the 4 respondent Superintendent of Police and another representation before the 2ND respondent District Collector on 13-04-2026 against the trespassers which is illegal, arbitrary, unjust, violation of Articles 14 300-A of the Constitution of India and consequently direct the respondents herein to take action on petitioners Complaints dated.31-03-2026, 06-04-2026 13-04-2026 made through petitioner brother against the persons who trespassed into petitioners subject house plot and also ensure that not to permit further construction in the subject house plot…” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3 3. Mr. Challa Siva Sankar, learned counsel for the Petitioner, submits that the Petitioner is a physically differently-abled person. He has submitted three representations dated 31.03.2026, 06.04.2026, and 13.04.2026 to the Respondent Police seeking necessary action against the persons who have trespassed upon the property of the Petitioner. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the Station House Officer has conducted a preliminary enquiry into the three representations submitted by the Petitioner and has observed that the issues raised therein are civil in nature. It further appears that the Petitioner has not instituted a civil suit before the competent civil court. 5. Be that as it may, when the complaints of the Petitioner were not considered by the Respondent Police, he has got alternative efficacious remedy under Section 190 read with 200 of ‘the Cr.P.C.,’ / Section 210 read with 223 of ‘the BNSS’ 6. Considering the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of granting liberty to the Petitioner to approach the learned Jurisdictional Magistrate by way of filing a private complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’ / Section 210 read with 223 of ‘the BNSS’. 4 7. On filing of such private complaint by the Petitioner before the learned Jurisdictional Magistrate, the learned Jurisdictional Magistrate is directed to bestow his attention to the same and deal with the complaint in accordance with law. 8. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
