The present Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, seeking appointment of an Arbitrator to adjudicate upon the disputes which have arisen between the parties under the Content Creation Agreements dated 25.01.2022 and 16.03.2022 (hereinafter referred to as “Agreements”). 2. It is the case of the Petitioner that under the Agreements, the Petitioner was engaged by the Respondent for end-to-end production of a web series comprising ten episodes. It is stated that in terms of the Agreements, the Petitioner undertook complete production responsibilities including shooting, editing, narration, dubbing, captioning and post This is a digitally signed order. It is stated that the Petitioner has performed its contractual obligations, however, the Respondent has failed to release the payments due and payable to the Petitioner leading to the disputes between the parties. 3. Clause 17.2 of the Agreements contains the arbitration clause by which the parties have agreed to get their disputes adjudicated through arbitration. The said clause specifically indicates that the venue of the arbitration shall be in Delhi. There is no contrary indicia that the arbitration proceedings shall be conducted elsewhere. 4. A notice under Section 21 of the Arbitration and Conciliation Act, 1996, was sent to the Respondent invoking arbitration on 17.02.2025 which has not been replied to by the Respondent. The Petitioner has, thereafter, approached this Court by filing the present Petition. 5. Notice in the present Petition was issued on 07.05.2026. 6. Mr. Aman Taneja, learned Counsel, enters appearance on behalf of the Respondent. Service therefore, stands complete. 7. In view of the fact that disputes have arisen between the Parties and the Agreements contain an arbitration clause, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 8. Accordingly, Ms. Deeparghya Datta, Advocate (Mob. No: 8910558067) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties. 9. The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 10.
