CORAM:
HON'BLE MS. JUSTICE MADHU JAIN O R D E R % 21.07.2026
1. This hearing has been done through hybrid mode.
2. By the way of this petition, the petitioner is seeking quashing of FIR No. 0596/2023, registered at Police Station GTB Enclave, Delhi, for the commission of offences punishable under Section 323/376/506 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) and all consequential proceedings emanating therefrom.
3. Issue notice. Learned APP accepts notice on behalf of the State.
4. Learned APP for the State opposes the prayer for quashing of the FIR and submits that the allegations levelled in the FIR are serious in nature.
5. The Petitioners and Respondent No. 2/prosecutrix are present before this Court and have been duly identified by their respective learned counsel.

matrimonial differences, pursuant to which FIR No. 0596/2023 dated 19.12.2023 under Sections 323/376/506 IPC was registered at P.S. G.T.B. Enclave, Delhi. During the pendency of the proceedings, the parties amicably resolved all their disputes through a Memorandum of Understanding dated 05.12.2025, and Respondent No. 2 has expressed her no objection to the quashing of the FIR and all consequential proceedings.
7. On a query made by this Court, Respondent No. 2 categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that she has been residing with Petitioner No. 1 since 2014 and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed.
8. In view of the fact that the parties have amicably resolved their matrimonial disputes, resumed cohabitation and have been living together, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the
facts and circumstances of the present case.
9. Accordingly, FIR No. 0596/2023, registered at Police Station GTB Enclave, Delhi, under Section 307 IPC, in which charges have been framed under Sections 323/376/506 IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
10. The present petition stands disposed of.
