AMARNATH GOUD O R D E R 05.03.2026 [1] Heard learned counsel appearing for the respective parties. [2] This present writ petition is filed under Article 226 of the Constitution of India seeking the following reliefs: “i) Issue rule asking the respondents to show cause as to why the respondents should not be directed to make the payment of compensation amounting to Rs.64,751/- and Rs.18,597/-in respect of the land acquired and damage of the trees and others etc. which is attached to the acquired land fallen under R.S. plot No.822 of Khatian No.222/1 and 222/2 of Mouja and Tehsil Damcherra, Revenue Circle Damcherra, under North Tripura District. ii) After disbursement of the awarded amount, your Lordship may direct the Land Acquisition Collector, Dharmanagar to refer the case under Section 18 of the LA Act, 1894 to the Ld. LA Judge, Dharmanagar for proper adjudication and proper determination of the compensation. iii) After hearing the parties and being satisfied make the rule in terms of (i) and (ii) above absolute. iv) Pass any other order/orders as your Lordship deem fit and proper having regards to the facts and circumstances of the petition.” [3] It is the case of the petitioner that the respondent No. 2 has acquired the property of the petitioner, though compensation has been fixed by the LA Collector, the amounts have not been disbursed and thus, the petitioner is before this Court. [4] After perusal of the record, it has been seen that by virtue of the document way back of 1980, the husband of the petitioner purchased the property vide registered documents and thereafter his death, the petitioner succeeded to the same and the survival certificate is also placed on record before this Court in this regard. [5] It has also been seen that the petitioner herein addressed notices to the concerned respondent(s) on several occasions ventilating her grievances and on 16.01.2025, the petitioner herein served a legal notice through the engaged counsel addressed to the concerned respondent(s) but, the same is still pending for adjudication. [6] In view of the same, without expressing any opinion on merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to consider the matter, more particularly in light of the legal notice dated 16.01.2025 filed by the petitioner’s counsel and take a decision as per merits of the case within a period of 02 months from the date of receipt of the copy of this order in accordance with law. [7] With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. DR.
