BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER 28.08.2026 Heard Mr. S. Khound, learned counsel appearing for the petitioner as well as Mr. P. S. Lahkar, learned Additional Public Prosecutor, Assam. 2. This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Rintu Das, has prayed for bail in connection with Duliajan PS Case No. 21/2026 u/s
Page No.# 2/3 80(2) of BNS corresponding to Sessions Case No. 78/2026. 3. The brother of the deceased lodged an FIR on 21/02/2026 with the allegation that his sister was married with the present petitioner and after her marriage; she was subjected to dowry demands, physically and mentally tortured, eventually leading towards suicide. 4. The investigation resulted in charge-sheet and subsequently, charges have been framed against the petitioner under Section 80(2) of BNS pertaining to dowry vide order dated 21/7/2026. It appears that Prosecution evidence has not started. The accused is stated to have been arrested soon after the lodging of the FIR on 22.02.2026 and since then he is in under trial detention. Total 9 witnesses are listed in the charge-sheet. 5. I have perused the scanned TCR. 6. The postmortem report does not reveal injuries on her body or private parts. However, ligature marks were found on her neck and she was also found to be carrying pregnancy at the time of her death. 7. Considering the length of the trial detention and the stage of the case, I am of the considered view that the petitioner can be granted bail at this stage, subject to suitable conditions. 8.
Accordingly, it is provided that the accused petitioner named above, shall be released on bail of Rs.50,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall be available for the trial, if one commences; (b) shall not hamper or tamper with evidence;
Page No.# 3/3 (c) shall not in any manner cause any threat or intimidation or harm upon the informant and his family members. 9. Violation of the bail conditions will entail cancellation of the bail petition. 10. In view of the above, this bail application stands allowed and disposed of. JUDGE Comparing Assistant
