This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Md. Saifuddin Hussain, has prayed for bail in connection with Sonapur PS Case No. 118/2026 (corresponding to GR No. 3382/2026) u/s Page No.# 2/2 281/105/324(4)/324(5) of BNS 3. It is submitted by the learned counsel for the petitioner that despite taking precautions the incident took place and he is in no way responsible for any criminal negligence or knowledge of causing death in the unfortunate incident. It is also submitted that the wife of the petitioner has recently gave birth to a child and for which he needs to be near to his family. 4. The learned Additional Public Prosecutor submits that it is revealed from the mouth of some of the witnesses that the vehicle was in high speed at the relevant time. Nevertheless, considering the facts and circumstances, the progress of investigation and length of detention, the petitioner is hereby allowed to go on bail of Rs.50,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall co-operate with remaining investigation; (b) shall not hamper or tamper with evidence; 5. In view of the above, this bail application stands allowed and disposed of. 6. Return the case diary. JUDGE Comparing Assistant
