JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in Crime No.299/2023 registered for the offences punishable under Sections 420 and 506 r/w Section 34 of IPC and Sections 3(i)(r) and (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2. Heard Sri. Vachan Gowda, learned counsel appearing for Smt. Vijetha R Naik, learned counsel for the petitioners, Sri. K Nageshwarappa, learned counsel for respondent No.1, Sri. Yogeesh N.C., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a interlocutory compromise application along with the joint verifying affidavit. The compromise application reads as follows: "INTERLOCUTORY COMPROMISE APPLICATION UNDER SECTION 482 OF THE CRIMINAL - 4 - HC-KAR NC: 2026:KHC:8386 CRL.P No. 11990 of 2023 PROCEDURE CODE. The Petitioners and Respondent no.2 submit as follows: 1. The Petitioners has filed the accompanying Criminal Petition seeking for quashing of the Complaint, FIR in Crime No.299/2023 registered by the 1st Respondent Police against the Petitioners herein for offenses punishable under Sections 420, 506 of IPC & Sections 3 (i) (r) & (s) of the SC/ST Prevention of Atrocity Act and all further proceedings thereto, pending on the file of Special Court LXX Additional City Civil and Sessions Judge (CCH 71) Bengaluru. 2. The facts and grounds urged in the above Criminal Petition may kindly be read in concomitance with this application to avoid repetition of facts. 3. It is submitted that the Petitioners and the Respondent No. 2 on the advice of elders, well-wishers and friends have, in their mutual interest, decided to amicably resolve and settle all outstanding claims and disputes arising out of all dealings between them, whether personal or business. In furtherance thereof, the Petitioners have paid a sum of Rs.27,00,000/- (Rupees Twenty-Seven Lakhs Only) to the Respondent No.2 through D.D No.593588 drawn on State Bank of India, Kengeri Upanagara branch which was invested in the business and the Respondent No. 2 hereby confirms receipt of the said amount. 4. In light of the compromise, all claims made by the Respondent No. 2 in the complaint and FIR forming the subject matter of this petition, and in all proceedings - 5 - HC-KAR NC: 2026:KHC:8386 CRL.P No. 11990 of 2023 arising therefrom, stand unconditionally withdrawn and that no claims remain against the Petitioners. 5. Besides the present proceedings, the Respondent No. 2 has filed a Petition in M.C. No. 4621/2023 for the relief of restitution of conjugal rights against the Petitioner No.1, pending before the Learned 6th Additional Family Judge at Bengaluru. In view of this compromise, the Respondent No.2 undertakes to withdraw the M.C.No.4621/2023 unconditionally. 6. It is submitted that Petitioner No. 1 had filed a case of cheating against the Respondent No. 2, in which a B Report was filed by the jurisdictional police. The Petitioner No. 1 has also preferred a protest petition challenging the B Report. In view of the compromise between the parties, the Petitioner No. 1 undertakes to withdraw the protest petition and close the matter in terms of this settlement. 7. The Petitioners and the Respondent No.2 hereby withdraw all cases instituted against each other or their respective family members unconditionally. Both the parties herein hereby confirm and agree that they do not have any kind of relationship between them either business or personal and also undertake not to interfere in each other's life and profession henceforth. This compromise is binding on all the parties herein for all times to come. WHEREFORE, the Petitioners and the Respondent No.2 most humbly pray that this Hon'ble Court be pleased to quash the entire proceedings in Crime No.299/2023 (Spl.C.C No.2449/2023) registered by the 1st Respondent - 6 - HC-KAR NC: 2026:KHC:8386 CRL.P No. 11990 of 2023 Police against the Petitioner herein for offenses punishable under Sections 420, 506, R/w 34 of IPC & Sections 3 (i) (r) & (s) of the SC/ST Prevention of Atrocity Act, pending on the file of Special Court LXX Additional City Civil and Sessions Judge (CCH 71) Bengaluru, in the interest of justice." 4. Therefore, in light of the application for compromise being filed along with the joint verifying affidavit and offences not being against the State, I deem it appropriate to accept the compromise application and terminate the proceedings pending against these petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.299/2023 pending before the Special Court LXX Additional City Civil and Sessions Judge (CCH-71) Bengaluru stand quashed, qua the petitioners.
