JUSTICE DEVASHIS BARUAH ORDER 30.01.2026 Heard Mr. HR Ahmed, the learned counsel appearing on behalf of the petitioner. Ms. S Baruah, the learned CGC, who appears on behalf of all the respondents. 2. The petitioner herein is aggrieved by the rejection of his candidature for the post of Constable (GD) in the Central Armed Police Force pursuant to the notice Page No.# 3/4 dated 05.09.2024 on the ground that the petitioner has been declared unfit by the Review Medical Examination Board due to Scoliosis (Abnormal curvature of Spine). This report was given on 24.11.2025. 3. The petitioner thereupon appeared before the Gauhati Medical College and Hospital, (for short, the GMCH), Guwahati and an X-ray was conducted in the Dorsal Spine(AP & LAT View), wherein also it was opined that there was mild Scoliosis. 4. The petitioner thereafter submitted a representation dated 08.01.2026, but the same was not considered and as such the petitioner has approached this Court by way of the present writ petitioner. 5. This Court has duly taken note of that in the detailed medical examination which was conducted on 17.11.2025, it was opined that the petitioner had Dorsal Scoliosis Towards (Rt). Thereupon a request was made by the petitioner for a review medical examination. 6. An expert opinion was taken from the Orthopedic Department wherein it was opined that there was minimal Scoliosis and under such circumstances, the Review Medical Examination Board declared the petitioner unfit due to Scoliosis (Abnormal Curvature of Spine). 7. The materials which the petitioner has placed before this Court of the Gauhati Medical College and Hospital opines that there is mild Scoliosis. A question, however, arises as to whether a mild Scoliosis would be a General Ground for Rejection taking into account Clause 6.13 of the Uniform Guidelines For Medical Examination Test (MET) for Recruitment in CAPFs, NSG & AR, (for short, the Uniform Guidelines) more particularly, when at Clause XI, the Uniform Guidelines stipulates what is required to be looked into. This Court does not have the expertise to decide as to whether the opinion so rendered by the GMCH would bring the petitioner within the purview of the General Grounds for Rejection, more particularly, Clause 6.13 read with what is required to be looked into in terms with Clause XI of the Uniform Guidelines. 9. Under such circumstances, this Court, therefore, disposes of the instant writ petition with a direction to the respondent No.5 to ascertain on the basis of the medical opinion so rendered by the GMCH that the petitioner has mild Scoliosis towards right marking an angle of 13 degree and as to whether the same would fall within the ambit of the General Grounds For Rejection as stipulated under Clause 6.13 of the Uniform Guidelines. The said aspect be considered and decided within a period of 15(fifteen) days from the date a certified copy of this order along with the original report of the GMCH, Guwahati is served upon the Presiding Officer of the respondent No.5. 10.
