JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking following prayer: "WHEREFORE, the petitioners most humbly pray that this Hon'ble Court be pleased to: a) ISSUE a Writ of Mandamus or any other appropriate writ to the Respondent Bank to provide a final statement of account and to accept the full and final payment of the entire loan amount from the Petitioners within a reasonable time frame to be fixed by this Court, thereby regularizing the account and discharging the mortgage. a b) ISSUE Writ of Mandamus directing the Respondent Bank to restore the physical possession of the residential and commercial premises to the Petitioners immediately upon receipt of the final payment. c) Return the original documents and discharge the mortgage in respect of the property mortgaged. c) GRANT such other and further orders as this Hon'ble Court may deem fit in the interest of justice and equity." 2. In the light of the judgment passed by the Hon’ble Apex Court in Civil Appeal Nos.257-259/2022 between Phoenix ARC Private Limited Vs. Vishwa Bharathi Vidya Mandir and others arising out of WP.Nos.35564-35566/2015 dated - 4 - HC-KAR NC: 2026:KHC:14675 WP No. 8283 of 2026 27.03.2018, the present writ petition is not maintainable against UGRO Capital Ltd/the respondent. 3. In that view of the matter, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of giving liberty to the petitioner to avail the appropriate remedy. ii.
