The petitioners claim to be the co-sharer in L.R. Plot Nos. 77 and 78 within Mouza Purbadobandi in the District of Purba Medinipur. The petitioner alleges that the private respondents have constructed a pucca construction encroaching upon the public land belonging to the Irrigation Department thereby causing obstruction to the ingress and egress of the petitioners in the said property. The petitioners made a representation dated 25th June, 2025 before various authorities including the Executive Engineer, Department of Irrigation and Waterways Directorate. The learned advocate appearing for the petitioners submits that no decision on such representation has been communicated to the petitioners till date. The learned advocate appearing for the State submits that the said representation shall be considered and after making necessary enquiries a decision shall be
2 taken which shall be communicated to the petitioners within the time limit that may be allowed by this Court. In the light of the submissions made by the learned advocates for the respective parties, WPA 21356 of 2025 stands disposed of by directing the Executive Engineer, Department of Irrigation and Waterways Directorate being the 6th respondent herein to consider the representation of the petitioners dated 25th June, 2025, make necessary enquiries and if any encroachment is found to take steps in accordance with law. The reasoned order shall be passed on the said representation which shall be communicated to the petitioners and any other parties who may be affected by such decision as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with a copy of the representation dated 25th June, 2025. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
