Gupta ….for the State The petitioner has approached the arbitrator under Section 3G(5) of the National Highway Act, 1956, challenging the compensation determined by the competent authority under the National Highway Act, 1956. The learned advocate appearing for the petitioner submits that in spite of submission of the appropriate application, the arbitrator has not taken any further steps on the application submitted by the petitioner. Ms. Roy, learned advocate appearing for the National Highways Authority of India submits that the Divisional Commissioner, Burdwan Division has been vested with the power to act as an arbitrator under Section 3G(5) of the 1956 Act. Such submission of Ms. Roy, learned advocate, is placed on record. 2 Since the petitioner has approached the appropriate authority under Section 3G(5) of the 1956 Act, WPA 3897 of 2026 stands disposed of by directing the Divisional Commissioner, Burdwan Division, being the respondent No.4 to dispose of the application submitted by the petitioner as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order.
