INDIRESH ORAL ORDER In this petition, the petitioner is seeking an order of appointment of Arbitrator to resolve the disputes and differences arisen between the petitioner and respondent as per Clause 3 of the Terms of the Proposed Joint Development of the Schedule Property in Memorandum of Understanding dated 18th July, 2022 (Annexure-A). 2. Heard Sri. H. Mujtaba, learned counsel appearing for the petitioner. Respondent is served and remained absent. 3. Having heard the learned counsel appearing for the parties, I have carefully perused Clause 3 of the Terms of the Proposed Joint Development of the Schedule Property in Memorandum of Understanding dated 18th July, 2022 (Annexure-A), which provides for resolution of dispute between the parties through an Arbitration. In that view of the matter, I am of the view that, a retired District Judge be appointed as Arbitrator to resolve the dispute between the parties. - 3 - HC-KAR NC: 2026:KHC:18429 CMP NO.525 OF 2025 4. Therefore, Sri. D.R. Venkatasudarshana, District Judge (Retired) is appointed as an Arbitrator to resolve the dispute between the parties in the Arbitration and Conciliation Centre (Domestic and International), Bengaluru. 5. All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal. 6. A copy of this order be sent forthwith to the Arbitration and Conciliation Centre (Domestic and International), Khanija Bhavan, Bengaluru for proceeding further in the matter. 7. Registry is directed to return the original documents if any, produced by the parties, after obtaining photostat copy of the same for the file.
